OPEN TO LEGAL RESIDENTS OF THE 48 CONTIGUOUS UNITED STATES OF AMERICA AND DISTRICT OF COLUMBIA, 18 AND OLDER AS OF TIME OF ENTRY
- WHEN TO ENTER: Romano's Macaroni Grill ("Sponsor') "My Amore Contest Promotion" ("Promotion") consists of three (3) separate "My Amore Contests", each with different starting/ending dates and different prizes. The Contest periods are as follows:
- My Amore Contest I: Starts on 2/18/08 at 12:00 A.M., ET and ends on 4/27/08 at 11:59:59 P.M., ET ("Contest Period I"). All entries must be received by 4/27/08 at 11:59:59 P.M., ET.
- My Amore Contest II: Starts on 4/28/08 at 12:00 A.M., ET and ends on 9/14/08 at 11:59:59 P.M., ET ("Contest Period II"). All entries must be received by 9/14/08 at 11:59:59 P.M., ET.
- My Amore Contest III: Startson 9/15/08 at 12:00 A.M., ET and ends on 2/8/09 at 11:59:59 P.M., ET ("Contest Period III"). All entries must be received by 2/8/09 at 11:59:59 P.M., ET.
- HOW TO ENTER: Go to myamore.macaronigrill.com during the respective Contest Period and complete the Registration Form. On the Registration Form, carefully follow the instructions to select your favorite dish from the current Romano's Macaroni Grill menu selections and write and submit an essay in 250 words or less stating why the dish selected is your favorite dish ("Essay"). Limit: One entry per person throughout the Contest Period, regardless of email address used. Contest entry is on-line only.
- HOW THE CONTEST WORKS:(A)Random Drawing: 1) My Amore Contest I: On or about 5/02/08, 1,000 Essays will be randomly selected by an independent judging agency from among all eligible Essay entries that were submitted during Contest Period I.; 2) My Amore Contest II: On or about 09/22/08, 500 Essays will be randomly selected by an independent judging agency from among all eligible Essay entries that were submitted during Contest Period II. 3) My Amore Contest III: On or about 02/16/09, 500 Essays will be randomly selected by an independent judging agency from among all eligible Essay entries that were submitted during Contest Period III. (B) Essay Requirements: Regardless of which Contest you are entering, your Essay must conform to all of the requirements stated in Rule 5 below or it will be deemed ineligible to win a prize. (C)Selection of Winning Essays: 1) My Amore Contest I: Beginningon or about 5/03/08, a panel of judges from Romano's Macaroni Grill culinary and marketing organizations ("Contest Judges") will read the 1000 Essays selected in the random drawing and will evaluate each Essay based on the criteria set forth in Rule 3(D) below; 2) My Amore Contest II: Beginning on or about 09/23/08, Contest Judges will read the 500 Essays selected in the Contest Period II random drawing and will evaluate each Essay based on the criteria set forth in Rule 3(D) below;My Amore Contest III: Beginning on or about 02/17/09, Contest Judges will read the 500 Essays selected in the Contest Period III random drawing and will evaluate each Essay based on the criteria set forth in Rule 3(D) below: (D)Judging Criteria Applicable to Each Contest Period: (1) Essay Creativity: 60%; (2) Demonstration of a Passion for Food: 30%; (3) Description of the situation in which the food was enjoyed - 10%. My Amore Contest I: The Essay with the highest score will be declared the winning "My Amore" Grand Prize Winner, and the Essays receiving the next 50 highest scores will be declared the "My Amore" First Prize Winners. My Amore Contests II and III: The five (5) Essays in My Amore Contest II and the five (5) Essays in My Amore Contest III with the highest scores will be declared the respective winning My Amore First Prize Winners. Regardless of the respective My Amore Contest involved, in the event of a tied score, the Essay receiving the highest score for Criteria 1 will be declared the winner of the tie. If a tied score still remains, a new Contest Judge will review the tied Essays and break the tie. The decisions of the Contest Judges will be final regarding the selection of winning Essays. The potential Grand and First Prize Winners of My Amore Contest I will be notified by phone, email and/or mail on or about 6/06/08; the potential First Prize Winners of My Amore Contests II and III will be so notified on or about 10/23/08 and 03/17/09, respectively. Odds of winning depend on the number of eligible entries submitted in the respective My Amore Contest and the decision of the Contest Judges.
- PRIZES: My Amore Contest I: Grand Prize (1): One (1) Grand Prize Winner will receive a private four (4) course dinner at a local Romano's Macaroni Grill Restaurant for him/herself and nine (9) of his/her friends prepared by a Romano's Macaroni Grill chef and a Five Hundred Dollar ($500) Romano's Macaroni Grill Gift Card. Specific dinner location and arrangments will be as designated by Sponsor. Name of Grand Prize Winner and his/her Essay may be posted on the My Amore contest website and/or online menu at www.macaronigrill.com following the end of the Contest (ARV: $2,000) First Prize (50): Fifty First Prize Winners will each receive a One Hundred Dollar ($100) Romano's Macaroni Grill Gift Card (ARV: $100 each). The names of the First Prize Winners and their Essays may be posted on the My Amore contest website and/or online menu at www.macaronigrill.com following the end of the Contest. Gift Cards must be used in accordance with their terms and conditions and as allowed by state law. My Amore Contest II and III: Five (5) First Prize Winners in each Contest will receive a Fifty Dollar ($50) Romano's Macaroni Grill Gift Card. (ARV: $50 each). Gift Cards must be used in accordance with its terms and conditions and as allowed by state law. The names of the First Place Winners for each contest and their essays may be posted on the My Amore contest website and/or online menu at www.macaronigrill.com following the end of the Contest. NOTE: If you have won a prize in any of the My Amore Contests, you are not eligible to enter or win another My Amore Contest.
- ESSAY REQUIREMENTS: The Essay may not exceed 250 words. It may not mention, contain, refer or otherwise allude to the name, trademark or logo of any person, entity or character, company, brand, product other than those of Sponsor. The Essay may not contain any obscene, lewd, violent, offensive or otherwise inappropriate words, abbreviations, language, images, illustrations, photos, pictorial depictions, signs, symbols, emblems or references, regardless of whether such are of a commercial, political, personal, religious, satirical or other nature, and it must not in any way reflect negatively upon the Sponsor or its brands as determined by the Sponsor in its sole discretion. The Essay must, as more fully described in Rule 6 below, be totally your own original creation, not infringe or in any way violate any third-party intellectual property or privacy rights, and be one in which you (or your parent/legal guardian if you are a minor in your state of residence) agree to transfer, and assign all rights and title to Sponsor.
- CONTEST TERMS OF ESSAY SUBMISSION: By submitting an Essay, an entrant (or if entrant is a minor in his/her state of residence, his/her parent or legal guardian) represents and warrants that she/he has carefully read these Official Rules, including the language contained in this Rule 6. If entrant is a minor in his/her state of residence, all representations, acknowledgments, warranties, grants and waivers will be deemed to have been made by/his her parent or legal guardian,. (A)Entrant Representations &Warranties: By submitting an Essay, an entrant represents and warrants that (i) his/her Essay is his/her own original work and that she/he has not copied or used other works of others in his/her Essay without permission or right to do so; (ii) no person other than entrant has any right, title or interest in any part of the Essay; (iii) his/her Essay will not infringe or violate any rights of any third party or entity, including, without limitation, trade secret, copyright and trademark, defamation, privacy and publicity, false light, idea misappropriation or any contractual rights; and (iv) she/he has all the rights, licenses, permissions and consents necessary to submit the Essay in accordance with these Official Rules. (B) Sponsor's Property/Grant of Rights/Waivers: By submitting an Essay, an entrant agrees that his/her Essay will become Sponsor’s property and that it will not be returned. By submitting an Essay, an entrant additionally grants and assigns to Sponsor all title to the Essay, including all its copyright, trademark and other intellectual property rights, and grants and assigns to Sponsor and its designees a worldwide, royalty-free, perpetual, unrestricted, irrevocable and fully sub-licensable right and license to consider, disclose, use, re-use, reproduce, edit, modify, digitize or enhance, adapt, change, edit, publish, translate, create derivative works from, distribute, redistribute, and/or display his/her Essay (in whole or in part), and/or incorporate all or part of his/her Contest Entry in other works, all in any manner and in any form, format, or media anywhere in the world at any time, as well as in connection with any distribution or syndication arrangement with third parties or third-party sites, in any media format or medium and through any media channels for future advertising, marketing, manufacture and/or sale, commercial, promotion and publicity or other purpose in any manner, without further notice or compensation to entrant. Entrant waives any and all “moral rights” she/he may have in the Essay. Entrant grants Sponsor these rights whether or not entrant's Essay is selected as a Winner. Entrant understands and acknowledges that entrant WILL NOT BE PAID FOR OR RECEIVE ANY FORM OF COMPENSATION for his/her CONSENT Entry or for granting Sponsor these rights other than any prize that entrant may receive due to being selected as the grand or first prize contest winner. Sponsor is in no way obligated to use any Contest entry and entrant may or may not be given any credit or attribution if his/her Contest entry is subsequently used. Entrant agrees to waive all claims to receive any royalties of any kind now or in the future from Sponsor or its designees for any use of his/her Contest entry, including copyright or trademark royalties, and entrant represents, warrants and agrees that no other party is entitled to claim any royalties from its use. Entrant also acknowledges that other individuals may have submitted similar or identical Essays which Sponsor may have the right to use.
- ELIGIBILITY: Contest is open only to legal residents of the 48 contiguous United States and District of Columbia, 18 years of age or older at the time of entry, except employees and members of their household and of their immediate family (i.e. parents, children, siblings, spouse and members of such immediate family member's household) of Sponsor, its affiliates, divisions, subsidiaries; its advertising/ promotion agencies, judging organization; or any third party associated with the development, administration or supply to this Contest (collectively, "Sponsor, & Others"). Contest void in Alaska, Hawaii and Puerto Rico, and where prohibited, taxed or restricted by law. Potential Grand Prize Winner will be required to sign and return Affidavits of Eligibility/Compliance & Publicity/Liability Release, where permitted by law. Failure to sign and return these and other such requested documents by the return date specified in the Prize notification letter will result in forfeiture of the Prize and selection of an alternate potential Winner. Grand Prize Winner will also be required to provide his/her Social Security Number for tax reporting purposes and will receive a Form 1099.
- Internet: Sponsor & Others are not responsible for interrupted or unavailable network server, browser, or other connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled or misdirected entries or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person's computer related to participating in the promotion. Sponsor, et al. are not responsible for illegible, unintelligible, late, lost or stolen entries or incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the promotion or by any technical or human errors which may occur in the processing of any entries in this promotion. Persons found tampering with or abusing any aspectof this promotion, as solely determined by Sponsor, will be disqualified and may be subject to prosecution. Any entrant, who attempts to play with multiple e-mail addresses, under multiple identities or uses any device or artifice to play multiple times, will be disqualified from participation in the Contest. If, in the judgment of Sponsor, the Contest is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor, which corrupts the administration, security, fairness or proper play of the Contest, Sponsor reserves the right, in its sole discretion to discontinue, suspend or terminate the Contest. In the event of any such discontinuation, suspension or termination, the Essays to be selected as described in Rule 3 will be determined from among all eligible entries received to date, in a random drawing to be conducted by the judges following the discontinuation, suspension or termination. Any personally identifiable information collected during an entrant's participation in this promotion will be collected by Sponsorand used by Sponsor, its affiliates, agents and marketers for purposes of the proper administration and fulfillment of the Contest as described in these Official Rules and in accordance with Sponsor's Privacy Policy as stated at http://www.brinker.com/terms.asp. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF the CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. This promotion is subject to all applicable federal, state and local laws and regulations. The interpretation of these Official Rules shall be governed by the laws of the State of Texas. Any and all disputes will be resolved individually, without resort to class action, in the appropriate courts in the State of Texas exclusively, and subject to the laws of the Texas. Should there be a conflict between the laws of the State of Texas and any other laws, the conflict will be resolved in favor of the laws of the State of Texas.
- GENERAL CONDITIONS: By entering, participants agree that they have read these Official Rules, will be bound by them, and that the decisions of the independent judging agency administering this Contest shall be final in all matters pertaining to this Contest. Entry of an Essay into this Contest shall constitute and signify the entrant's agreement and consent that Sponsor may use the entrant's first name, initial of last name, address (city, state), for promotional purposes worldwide, including on the Internet, without limitation and without further payment or consideration, except where prohibited by law. Sponsor, et al. are not responsible for any liability whether directly or indirectly, including, without limitation, liability in connection with any injuries, damages or losses of any kind, whether direct or indirect, whether to property or person, including death, arising out of the acceptance, enjoyment, use and/or misuse of the Prize and/or participation in this Contest, and they will be held harmless against any claims of liability arising directly or indirectly from the Prize awarded or participation in this Contest. Sponsor shall not be responsible for illegible, damaged, lost, late, stolen, postage due, incomplete, undelivered/undeliverable, misdirected or returned entries and/or mail. All federal, state and local laws apply.
